Before the merits of a workers’ compensation claim could even be considered, Senior Associate Attorney Connie Parker had to answer a threshold question: did California have jurisdiction over an injury that allegedly happened outside the state?
Under Labor Code §3600.5, that comes down to two things – was the applicant regularly employed here, and was his employment contract accepted here. Connie’s attention to detail turned up inconsistencies across the applicant’s employment history, multiple addresses, different names used for employment, and conflicting accounts of where the agreement was actually formed.
The Workers’ Compensation Appeals Board agreed the applicant’s testimony wasn’t credible and fell short of establishing jurisdiction. The result: a Take Nothing order for our client, and a strong showing of the groundwork Connie put in to build and present the defense.
Congratulations, Connie!
